Adjudication in BriefAdjudication is the preferred method of settling payment disputes in Queensland, NSW, New Zealand and Singapore. Although there are no limits to the size of a claim an adjudicator may request an extension of time before accepting a large application. This will then have to be agreed to by both parties before the adjudicator will accept the application. Essentially, a qualified adjudicator decides on disputed payments in the construction industry. There is no mediation or discussion at this stage and the adjudicator will not enter into negotiations with either party involved. His/ her job is to decide the amount of the disputed payment claim the applicant should receive and to allocate adjudication costs to either or both parties. The largest decided amount to date using this legislation is $39 million and the smallest amount being $250.00, both in NSW. The average time span for an adjudication from the application date to payment is approximately 25 working days for a standard adjudication. The adjudicator's decision is effectively final. The courts have been reluctant to interfere with adjudicator's decisions and since December 2007, adjudicator's decisions are excluded from the court's review under the Judicial Review Act.
